New Recovery Opportunity: $1.22 Billion Discover Class Action Settlement

There is a new recovery opportunity for your business to for those who accept Discover cards. You may or may not have received some forms recently in the mail about a $1.22 billion class action settlement against Discover. If you did, that is great. If you did not, that is fine too. It does not mean you are not eligible for this recovery.

You may remember that Brady Ware formed a partnership with a leading class action claims management firm, Financial Recovery Strategies (FRS). Many of you have taken advantage of working with FRS and their CRO, Harris Love, on the Dealer Management Systems (DMS) case for auto dealers or the Visa Mastercard settlement (Payment Card Interchange Fee, or PCIF) opportunities.

The Discover settlement is for End Merchants (those that accept credit cards for payment of a product or service), at any point, from January 1, 2007, through December 31, 2023. Therefore, if you have a newer business that was not eligible for PCIF (end date was January 25, 2019), but would be eligible for Discover, now is your opportunity to get your rightful recovery. The settlement was based on overcharges of interchange on some Discover transactions. The filing deadline for this claims process is May 18, 2026. Once you visit that link, you can enter your company’s information. Once you hit SUBMIT on that page, an Adobe Sign e-signature Agreement and Authorization will be sent to the email address that you enter in the portal. Once you e-sign the forms, you will be all set, and FRS will take things from there. If you do not receive the Adobe Sign forms within a minute or two of hitting submit, make sure to check junk/spam to see if the email went there.
